The Court of Appeal has delivered what many political observers are already describing as a major setback for the camp aligned with FCT Minister Nyesom Wike, setting aside a controversial lower court ruling that had installed a caretaker leadership for the Peoples Democratic Party (PDP).
In a judgment that could significantly alter the balance of power within the opposition party, the appellate court faulted the trial court for venturing beyond the issues placed before it and granting reliefs that were neither sought nor canvassed by the parties.
The appellate court held that if the dispute before the lower court was limited to the validity of the PDP National Convention held on November 15 and 16, 2025, then the trial court had no legal basis to proceed further and pronounce a particular caretaker committee as the lawful authority to run the affairs of the party.
According to the appellate court, such action amounted to the court exceeding its jurisdiction and acting ultra petita—a legal term used when a court grants reliefs beyond what litigants requested.
The judgment stated that under such circumstances, the offending portions of the lower court’s decision would ordinarily be liable to be set aside as a nullity.
In a significant twist, however, the Court of Appeal went further to observe that ordering a retrial would serve no practical purpose because the central legal issue capable of returning to the lower court remained the validity or otherwise of the disputed convention.
The ruling effectively dismantles the legal foundation upon which the caretaker arrangement relied and is being interpreted by party insiders as a major victory for forces seeking a return to constitutional order within the PDP.
Political analysts say the decision is likely to strengthen the position of stakeholders who have consistently argued that the party’s leadership crisis should be resolved through established party structures rather than judicially imposed arrangements.
The verdict is also expected to energize supporters of former President Goodluck Jonathan, whose name has featured prominently in ongoing consultations and permutations regarding the future direction of the PDP ahead of the 2027 political cycle.
Although the court did not directly pronounce on any presidential ambition or political project, party sources believe the judgment removes a significant legal obstacle that had complicated internal realignments and succession calculations within the opposition party.
For the Wike camp, the ruling represents another chapter in an increasingly intense struggle for influence within the PDP, where competing blocs have battled for control of the party’s structure and strategic direction.
With the appellate court effectively rejecting the basis upon which the caretaker leadership emerged, attention is now expected to shift back to political negotiations, party mechanisms and fresh efforts to stabilize the PDP ahead of future electoral contests.
The judgment is likely to trigger renewed debate within the opposition party, but one immediate consequence is already evident: the legal ground beneath the caretaker arrangement has been severely shaken, opening a new phase in the battle for the soul of the PDP.
