Court Issues Form 49 Against Omobayo – Faces Imprisonment for Contempt

The Federal High Court, Abuja Division, has issued Form 49 against the deputy governor Engr. Mavilious Omobayo, imposed by Governor Godwin Obaseki, as a consequence of his failure to comply with a prior court order.

The court has directed Engr. Marvellous Omobayo Godwins to be committed to prison for disobeying the order issued on July 17, 2024. The court’s ruling referenced several constitutional provisions, particularly Section 188(5), (6), (7)(e), (b), (8), (9), and (11), in conjunction with Section 36(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended). These sections pertain to the impeachment process, fundamental rights, and the due process of law.

The court order arises from a suit **(SUIT NO: FHC/ABJ/CS/478/2024) brought by Rt. Hon. Philip Shaibu against the Inspector General of Police, the Deputy Governor of Edo State, the Attorney General of Edo State, the Chief Judge of Edo State, the Speaker of the Edo State House of Assembly, and the Edo State House of Assembly.

In response to Omobayo’s disregard for the court’s directive, the judge has issued Form 49, signaling a contempt of court charge, which could lead to Omobayo’s imprisonment. The ongoing legal battle highlights the deepening political tensions in Edo State, with Rt. Hon. Shaibu’s suit challenging the legitimacy of Omobayo’s position as deputy governor.

The matter remains under legal proceedings, and the issuance of Form 49 suggests that the court is prepared to enforce its orders unless Omobayo complies or appeals successfully.
