Hearing in to the case of alleged “criminal conspiracy and kidnapping” brought against Mr. David Solomon, and Mrs. Janet Funso Adeniyi by a Magistrate Court in Bwari Area Council, of the Federal Capital Territory, Abuja has adjourned to 7th August 2023.
The Magistrate, of the Bwari Magistrate Court 6, Justice, Taribo Zimizu also adjourned for ruling on the bail for the 2nd defendant Mrs. Janet Funso Adeniyi, mother of the two children to August 2nd 2023 after hearing the motions of the prosecuting and defence counsels.
Janet is the Mother of David Solomon and the twins allegedly kidnapped but are in the custody of the Lagos state ministry of youth and social development, for alleged abuse.
The prosecuting lawyer, Okoro Nnachi who held brief for Adama Musa prayed the court, not to grant bail to the second accused as he feared the mother of the children may jump bail.
He further argued that 2nd defendant must submit her British passport to the court to guarantee that she will not constitute a flight risk to the court.
In his counter motion, the defence attorney, Ken Ogbobo said the court should cancel the terms of bail condition proposed by the prosecuting counsel in its entirety.
He told the court that the mother of the children does not constitute flight risk as her Nigerian international passport with which she travels in and out of the country has been deposited with the court.
He pointed out to the court that the British passport of the mother of the kids that were allegedly kidnapped by her and her son (David) was missing and this was further confirmed by the tendered report of police investigation.
He asked the court to grant the second defendant bail on grounds of satisfactorily meeting the bail conditions, stressing that the missing British passport does not make her a flight risk.
Ogbobo also asked the court to grant bail to the 1st defendant David Solomon, whose bail was revoked due to his absence at the July 17 hearing owing to ill health.
He said the defendant did not jump bail but was receiving treatment for a critical health condition for which the court has been provided evidence.
The court has reserved for ruling on the variation of bail condition for the 2nd defendent on August 2, 2023.
