Impeachment Tension: Rivers APC Asks Chief Judge to Obey Court Order on Fubara

The Rivers State chapter of the All Progressives Congress (APC) has appealed to the Chief Judge of the state, Justice Simeon Amadi, to strictly observe an existing court injunction halting all actions connected to the impeachment process against Governor Siminalayi Fubara and his deputy, Prof. Ngozi Odu.
The appeal was contained in a statement issued on Saturday by the party’s State Publicity Secretary, Darlington Nwauju, following a resolution by the Rivers State House of Assembly directing the Chief Judge to set up a seven-member panel to investigate allegations of misconduct against the governor and his deputy.
The Assembly, during Friday’s plenary session, had resolved to move ahead with impeachment proceedings, citing what it described as persistent disregard by the governor for legislative interventions.
However, the impeachment move was stalled by an interim order of a Rivers State High Court sitting in Oyibo Local Government Area, presided over by Justice F. A. Fiberesima. The court restrained the Speaker of the House, the Clerk, and the Chief Judge from acting on any impeachment-related correspondence for seven days and adjourned the matter to January 23, 2026, for hearing.
Reacting to the development, Nwauju—who spoke with the backing of former Minister of Transportation, Rotimi Amaechi—accused members of the House, including APC lawmakers, of engaging in what he described as a “legislative coup” against the party’s collective interest in the state.
He warned that the action could further strain the party’s cohesion and damage its public standing in Rivers State.
While acknowledging that Section 188 of the 1999 Constitution grants the legislature powers to initiate impeachment proceedings, Nwauju argued that the determination of “gross misconduct” remains largely subjective and politically interpretive.
“No matter how carefully framed the allegations may be, they remain issues of opinion in the court of public judgment,” he said.
The APC spokesman also called on the party’s national leadership to activate internal conflict-resolution mechanisms under Article 21(b)(iii) of the party’s constitution to prevent further escalation.
“We specifically urge the Honourable Chief Judge of Rivers State to respect the interim injunction in Suit No: OYHC/7/CS/2026,” the statement added.
With the court scheduled to hear the matter next week, political tension continues to mount in Rivers State amid deepening divisions between the legislature and the ruling party.
